Any model, performer or other individual is visible in any depiction of explicit sexual behavior presented on the website found at nakedmoms.pics was a minimum of eighteen years old at the time of the creation of those depictions.

Exemption: Content Produced by Third Parties

The operators or owners of nakedmoms.pics are not the "producers" (either primary or secondary) of any visual matter that may be explicitly sexual in nature, regardless of authenticity, that is displayed on that website. The operator of said website simply engages in the activities of transmission, storage, retrieval, hosting, or formatting of content, which may feature explicit sexual acts, that appears on the website due to actions taken by third-party users. All areas of the website that contain user-supplied content are under the control of the associated user. The operators are thus exempt from compliance with Section 2257 records keeping and labeling obligations as per 28 C.F.R. §75.1(c)(4). Any content on the website that, at the operator’s sole discretion, is found to be illegal, unlawful, obscene, defamatory, or which in any respect violates the website's terms of use or other policies may be taken down.

Exemption: Content Produced by Website Operator

In connection with any content appearing on the website, for which the website operator is deemed to be the “producer” (primary or secondary) pursuant to /as set out in 18 U.S.C. § 2257 and 28 CFR § 75, such content is not bound by the requirements of 18 U.S.C. § 2257 and 28 CFR § 75 because, among other things, it does not portray actual sexually explicit behavior.
